Felony DUI

A standard DUI in most jurisdictions is a misdemeanor. In certain situations, that misdemeanor can be raised to a felony. A felony DUI is a more serious charge and if convicted, carries with it harsher penalties. Anyone convicted of a felony DUI will be labeled a felon, which also carries its own implications.

What are Some Common Situations that May Result in Being Charged With a Felony DUI?

Prior Convictions

Under Florida DWI laws, if an individual already has two DUI convictions on record within 10 years, and you are caught driving drunk again, they will be charged with a Felony DUI. A 4th DUI conviction, no matter how far apart, will automatically result in a 3rd degree Felony.

Property Damage or Bodily Harm

A DUI resulting in serious bodily injury or property damage will also result in a Felony charge. DUI with bodily injury carries with it a penalty of up to twelve months in jail and fines of up to $1,000; DUI with serious bodily injury is considered a third-degree felony. If convicted, an individual will face up to 5 years in prison and fines of up to $5,000.

DUI Manslaughter is a serious offense. If an individual kills someone while driving under the influence, it will result in a 2nd degree felony, with up to 15 years in prison and a fine of up to $10,000. If the defendant leaves the scene of the accident after killing someone, the charge is even more severe; a first degree felony which is punishable by up to 30 years in prison and a fine of $10,000.
