Prior Convictions

Under Florida DWI laws, if an individual already has two DUI convictions on record within 10 years, and you are caught driving drunk again, they will be charged with a Felony DUI. A 4th DUI conviction, no matter how far apart, will automatically result in a 3rd degree Felony.

Property Damage or Bodily Harm

A DUI resulting in serious bodily injury or property damage will also result in a Felony charge. DUI with bodily injury carries with it a penalty of up to twelve months in jail and fines of up to $1,000; DUI with serious bodily injury is considered a third-degree felony. DUI Manslaughter is a serious offense. If an individual kills someone while driving under the influence, it will result in a 2nd degree felony, with up to 15 years in prison and a fine of up to $10,000.
